Babucarr Saidy and Ousainou Cham, staff of Aqua Energy Petrol Station, were convicted and sentenced to one year imprisonment each by Magistrate Sillah of the Kanifing Magistrates’ Court on 7 August, 2019, for breaking and stealing.
Babucarr Saidy was sentenced to an additional fine of D10,000 in default to serve one year imprisonment while Ousainou Cham was sentenced to a fine of D7,000 in default to serve one year imprisonment. They were also ordered to pay a compensation of D76,400 in default to serve two years imprisonment. They are to pay the compensation on or about 31 August, 2019. They should also produce two Gambian sureties who should deposit their ID cards with the registrar of the court and swear to an affidavit of means.
Sergeant 2717 Jallow presented a bill of indictment which stated that Babucarr Saidy and Ousainou Cham jointly conspired to commit a felony to wit breaking and stealing on or about 23 August, 2018, at Aqua Energy Petrol Station at Manjai, in the Kanifing Municipality of the Republic of The Gambia.
It was alleged that on the same day and place, while serving as employees at the said Petrol Station, they jointly stole the following: a laptop marked Lenovo valued at D20,000, a laptop marked HP valued at D20,000, a wireless router valued at D3,500, a CCTV set valued at D30,000, a satellite decoder valued at D1,400 and protein powder valued at D1,500, totaling D76,400, the properties of the company.
Prosecutors alleged that Ousainou Cham had in his possession a locally made pistol without authority on the same day and place.
